Capita Selecta European Law: EU Citizenship in a Constitutional Context: Political Rights

After this course:
  • the student has knowledge and understanding of the connections between the various legal sources of the concept of European Citizenship and the relationships between national, European and international law, as well as the connections and differences between the citizenship concepts in the Internal market, the Area of Freedom, Security and Justice and EU political citizenship;
  • the student knows how to interpret the case law of the Court of Justice of the European Union and of the European Court of Human Rights with regard to citizenship cases;
  • the student is able to apply regulations, legislation and case law, and is able to solve cases and to apply legal reasoning;
  • the student is able to collect, analyse, clarify and comment on judgments and other material, both independently and as part of a team.
Inhoud
This course will start by zooming in on the issue of citizenship in a conceptual sense. What makes someone a European citizen? Is citizenship only a container of rights, or does it also entail the membership of a political community? This will also include the political and constitutional dimension of EU citizenship. Besides, the meaning and effects of European citizenship in the context of the Area of Freedom, Security and Justice (AFSJ) and the Internal Market will be studied. With regard to the AFSJ, the course will discuss the interaction and balance between freedom, security and justice on the one hand and the citizens on the other hand. Attention will be given to policy areas as European asylum and immigration (and the position of non- EU citizens therein as opposed to EU citizens). Moreover, the challenges on the national legal orders and fundamental rights protection, in particular through the prism of mutual trust will be addressed. With regard to the Internal Market, an important issue is whether EU citizenship has a meaning and a value apart from the free movement of persons.
 
Key questions of the course are:
  • whether the political, Internal Market and AFSJ dimension of EU citizenship constitute a coherent citizenship concept?
  • to identify what the effects are of European citizens having rights and obligations vis-à-vis national legal orders, the EU legal order and even the international legal order.

Please note; This module can not count towards the degree in European Law in combination with the course RGMUIER023 EU Citizenship (5 EC) from the academic year 2017/2018.

General information

In period 3 you will follow 3 modules to be chosen from a total of 9 modules on topics of European law. Period 3 is divided into 3 sub-periods of three weeks each. For each of the sub-periods you need to choose one module from the three modules offered in that sub-period. It is not possible to do more than one modules in the same sub-period. A fourth module, which is compulsory, regards the Research and Thesis Trajectory (RTT), and starts already in period 1. This module must be completed before starting the actual writing of the thesis in period 4. One week in period 3 is dedicated entirely to the RTT and no capita selecta teaching is scheduled during that week. For more information on this module, see the separate information document on Blackboard. Each of modules equals 2,5 ECTS.

The modules allow you to submerge yourself into a specific area of European Union law in a small-scale setting (max. 15 students). It is an intense form of education, aimed at deepening your knowledge in a specific field of EU law and at developing skills which will be important for your professional career. This means that none of the modules will be concluded by an exam. Instead, you will be tested in other ways. You might have to write a position paper, a case note, a weblog, a policy advice paper or you may be tested on the basis of a presentation or your input in a negotiating exercise.

If you fail one of the modules, you may not repair your grade within that module. Instead, a reparation module will be offered in period 4. The content and approach of that module will only be made public at the end of period 3. If you fail more than one module, you will have to take the Capita Selecta course the next year.
