After this course:
  • the student has knowledge and understanding of important moral principles and concepts underlying modern legal systems.
  • the student has developed his ability to solve legal cases and has a more profound understanding of the chosen solutions by being able to understand the underlying moral concepts and principles.
  • the student is able to apply methods of (meta-) legal reasoning and present the outcome in a written paper.
Inhoud
This course gives an introduction to moral theories and the role they play in law, on the general level of the relation between law and moral theories as well as on the particular level of how legal problems can be understood from a moral point of view.

Effort requirements
Preparation of seminars (unless the co-ordinator has given prior consent to miss one seminar).
This course takes a legal philosophical or jurisprudential approach to ethical dilemma's as they arise in a legal context. The course consists out of two parts: in the first general part the relation between law and morality will be discussed. In the second part the most important Western moral theories will be presented, and the question raised how lawyers can deal with legal problems from the moral point of view. In their papers the students will choose a legal dilemma and apply the moral theories presented in class.
