Course goals
After completing this course students are able to:

  • apply basic skills of research, analysis, and argumentation to questions of European law. 
Content
Since the impact of European law on the daily lives of citizens has increased, knowledge of this field has become important for practitioners engaged in a wide range of professional activities. This course provides students with the necessary knowledge and skills to understand the extent of this impact. It begins with a critical overview of the legal system of the European Union: its origin, the evolution of its legal rules, the legal construct of economic freedoms, and European integration.
Subjects include: the Internal Market and European competition law, the legal foundations of the European Union; the institutions of the European Union and their decision-making competence; the sources of the law of the European Union; the relationship between the legal system of the European Union and those of member States; and the enforcement of European Union law at the European and national level. The sessions on economic law introduce the four freedoms and competition law on which the internal market is based and the way in which these policies are affected through Community law and upheld by the European Court of Justice.

Format
The first part of the course is structured on the basis of a lecture/seminar set up. The instructor introduces main issues each week in an interactive lecture, whereas seminars are meant to further discuss legal issues more in-depth on the basis of seminar questions and cases. This part of the course is concluded by an exam in the first week of November.
During the second part of the course, each student is part of two small groups (3-4 students). The first group is the research clinic group. Each group is assigned a researcher studying a particular EU related issue. The group then acts as host for their researcher-of-the-day, presents the research and leads the class discussion. The second group each student is part of is the moot court group. Students participate in a moot court simulation that consists of a written and an oral part.
